Welcome, and thank you for your interest in Vyasna ("Vyasna", "we", "us") and our shop at https://vyasna-shop.fourthwall.com (the "Shop"). These Terms govern your use of the Shop.

Please read them carefully. By accessing or using the Shop, you agree to be bound by these Terms and by our Privacy Policy.

1. WHO YOU ARE DEALING WITH

Vyasna is an independent art project. The artwork is created by an individual artist based in the European Union. We create the illustrations and designs, curate the collection, and set the prices shown in the Shop.

The Shop runs on the Fourthwall platform. Fourthwall, Inc. ("Fourthwall") acts as Merchant of Record, which means that Fourthwall — not Vyasna — is the seller and your contractual counterparty for every purchase. Fourthwall is responsible for:

- taking and processing your order and your payment;
- manufacturing the product and arranging shipping;
- collecting and remitting all applicable taxes, duties and import charges;
- handling order enquiries, cancellations, replacements, returns and refunds;
- the conformity, quality and safety of the products supplied.

Your purchase is governed by the terms Fourthwall presents to you at checkout and links from every product page. Those terms, not these, determine your rights in respect of the goods.

Vyasna does not manufacture, stock, sell, ship or deliver any product. Vyasna does not receive, hold or refund any payment, and does not hold your payment details. Vyasna gives no warranty or guarantee of any kind in respect of the products, and gives none on Fourthwall's behalf.

2. ELIGIBILITY

You must be at least 16 years old, or the age of digital consent applicable in your country, to use the Shop. If you are under 18, you may use the Shop only with the involvement of a parent or guardian. By using the Shop you confirm that the information you provide is accurate and that your use complies with applicable law.

3. ACCOUNTS

Some features may require an account. Accounts are created and maintained on the Fourthwall platform. You are responsible for keeping your credentials confidential and for activity under your account. If you believe your account is no longer secure, notify support immediately at vyasna-shop@support.fourthwall.com.

4. PRODUCTS AND PRICES

Products are made to order. Product images and mock-ups are illustrations: minor variation in colour, print position and garment measurements is normal and does not, on its own, constitute a defect. Where we publish our own measurements of a garment, they are provided as guidance within the stated tolerance.

We set the retail price shown in the Shop and may change it at any time. A price change never affects an order already placed.

The total payable, including any tax, duties and shipping, is calculated and displayed by Fourthwall at checkout in the applicable currency. All taxes, duties and import charges are collected and remitted by Fourthwall as Merchant of Record. Where charges are collected at checkout, you will not be asked to pay them again on delivery.

5. YOUR RIGHTS AS A CONSUMER

Because Fourthwall is the seller, your consumer rights in respect of the goods are exercised against Fourthwall. We set them out here so that you know what they are, not because Vyasna provides them.

Cancelling before production. Orders can usually be cancelled or amended before they enter production, using the link in your order confirmation email.

Right of withdrawal. If you are a consumer in the European Union, you have a statutory right to withdraw from a distance purchase within 14 days of receiving the goods, without giving a reason. Limited statutory exceptions exist; where an exception applies to a particular product, this will be disclosed to you before you complete your order.

Legal guarantee of conformity. Consumers in the European Union benefit from a legal guarantee of conformity of two years from delivery. If a product is defective, damaged, misprinted or otherwise not as described, you are entitled to a remedy at no cost to you.

How to exercise these rights. Contact vyasna-shop@support.fourthwall.com with your order number. For a defect, include clear photographs of the item on a flat, well-lit surface showing both the issue and the garment label — this is the fastest route to a replacement or refund. Refunds are issued by Fourthwall to the payment method you used; timing depends on Fourthwall's processor and your bank.

Vyasna cannot accept a return, process a refund, cancel or amend an order once placed, or issue a replacement, and nothing in these Terms is a promise by Vyasna that it will do so.

Nothing in these Terms limits or excludes your statutory rights as a consumer.

6. SHIPPING AND DELIVERY

Products are shipped to the address you provide at checkout, according to the delivery terms shown at that time. Production is on demand, so dispatch times are stated per product. Fourthwall arranges production, shipping and any customs formalities.

Vyasna has no role in fulfilment and is not responsible for production or shipping times, carrier delays, customs handling, parcels lost or damaged in transit, or delivery to an address entered incorrectly at checkout.

7. INTELLECTUAL PROPERTY

All artwork, illustrations, texts, names and designs in the Shop — including the bestiary entries, their catalogue colophons and the name Vyasna — are the intellectual property of Vyasna, and are protected by copyright and other laws.

Purchasing a product gives you ownership of that physical item for personal use. It does not transfer any rights in the artwork. You may not reproduce, copy, resell, print or otherwise commercially exploit the designs, in whole or in part, or create derivative works from them, without our prior written permission.

The Shop platform, its software and its interface belong to Fourthwall.

If you believe any material in the Shop infringes your rights, write to legal@infesum.com.

8. ACCEPTABLE USE

You agree not to use the Shop:

- for any unlawful purpose or in breach of applicable law;
- to infringe the rights of any third party, including intellectual property rights;
- to interfere with the operation or security of the Shop, including by introducing malicious code or attempting to circumvent access controls;
- to impersonate any person, misrepresent an affiliation, or provide false information;
- to collect personal data about other users without their consent.

9. FEEDBACK

If you send us suggestions or ideas about the Shop or our products, you agree that we may use them freely, without obligation or compensation. This does not apply to any material in which you hold rights and which you clearly identify as such.

10. AVAILABILITY AND CHANGES

We may modify, suspend or discontinue the Shop, or withdraw any design, at any time. We may update these Terms; the "Last Updated" date shows when. Changes apply to future orders and never retroactively to an order already placed. If a change is significant, we will make it visible in the Shop.

11. LIABILITY

We provide the Shop with reasonable care and skill. To the extent permitted by law, Vyasna is not liable for indirect or unforeseeable loss, or for loss arising from circumstances beyond our reasonable control.

Responsibility for the sale, production, delivery, taxation and conformity of the products lies with Fourthwall as Merchant of Record, as set out in Section 1. Claims relating to a product are made against Fourthwall under the terms presented at checkout.

We do not limit or exclude liability for death or personal injury caused by negligence, for fraud, for defective products under product liability law, or for any other liability that cannot be limited or excluded under applicable law. As a consumer, your statutory rights remain unaffected.

12. DISPUTES

Claims about a purchase — the order, the payment, the delivery, or the product itself — are directed to Fourthwall as seller, and are governed by the terms presented to you at checkout, including their dispute resolution provisions.

For anything concerning these Terms, the Shop itself or the artwork, write to legal@infesum.com first; most matters are resolved quickly. If you are a consumer, you retain the mandatory protections of the law of your country of residence and may bring proceedings before the courts of that country. Consumers in the EU may also use the European Commission's online dispute resolution platform.

13. GENERAL

If any provision of these Terms is found invalid, the remaining provisions stay in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent.

By using the Shop, you agree to receive communications from us electronically, including order confirmations and notices, and you agree that these satisfy any legal requirement that communications be in writing.
